NO – at least in German courts this is not the case. However, it is advisable to file your lawsuit soon, as time is running out. There is NO risk: you only have the opportunity to enforce your claim and recover your money.
NO. Many affected parties are already taking legal action against the cartel members. The manufacturers are very keen to maintain their relationships with customers and not lose them to competitors. Your suppliers were also not informed about the cartel and are therefore not affected.

If the outcome is successful, the procedural costs are first deducted, which amount to a flat rate of 5% of the compensation amount. This fixed cap ensures that you are not surprised by unexpectedly high procedural costs.
Afterwards, the remaining amount is divided in a ratio of 65:35 (client : litigation financer).
An example to illustrate:
If you receive, for example, 10,000 euros in compensation for a vehicle, 500 euros are deducted for procedural costs.
Of the remaining 9,500 euros, the litigation financer receives 3,350 euros (35%), so that you keep 6,175 euros.
An exact duration is difficult to determine. Courts are currently ruling in favor of the plaintiffs. If there is an early settlement, claims could be enforced more quickly. However, if the manufacturers maintain their current position, the proceedings could possibly drag on for several years. Usually, such a process takes between 10 and 18 months.
In this case, the litigation financer bears all incurred costs, including court, expert, and attorney fees as well as the costs of the opposing attorneys. You do not incur any costs.
The exact statute of limitations is disputed among lawyers. Our lawyers are of the opinion that claims still exist for purchases from January 1, 1998 onward.

The European Commission has published an official press release that gives you security. Under the section "Claim for damages," it is clearly stated that every injured party in such cases has the right to compensation. A Commission decision serves as binding proof of the illegal conduct of the cartel members and enables the claim for damages. Even if the Commission has imposed a fine on the companies, the claim for damages is not affected by this.
